Welcome to Stunning Hardwoods LLC (“Stunning Hardwoods,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of stunninghardwoods.com (the “Site”) and any purchases or services provided through the Site (collectively, the “Services”). By accessing or using our Services, you acknowledge and agree to these Terms and our Privacy Policy.

1. Eligibility

You must be 18 or older and legally capable of entering into binding agreements under Texas law to use our Services or make purchases.

2. Products and Sales

• Natural Variations: Our hardwood slabs are unique, natural products. Variations in color, grain, size, and character (knots, checks, cracks) are normal and not considered defects.

• As-Is Sales: Unless otherwise specified in writing, products are sold “AS IS” and “WITH ALL FAULTS.” This notice is intended to waive implied warranties to the fullest extent allowed under the Texas Uniform Commercial Code and the Texas Deceptive Trade Practices Act (DTPA).

• Pricing: All prices are listed in U.S. dollars and subject to change without notice.

• Sales Tax: We collect Texas sales tax unless you provide a valid resale or exemption certificate.

3. Shipping and Risk of Loss

• Risk of Loss: Title and risk pass to you upon delivery to the carrier.

• Inspection: Inspect shipments promptly and notify us of any shipping damage within 7 days.

• Lead Times: Any delivery estimates are approximate and not guaranteed.

4. Returns and Refunds

• Return Window: Eligible returns must be requested within 7 days of receipt.

• Condition: Items must be in original, unaltered condition.

• Non-Returnable: Custom-cut, finished, or special-order slabs are non-returnable.

• Process: Email contact@stunninghardwoods.com for a Return Authorization (RA). You are responsible for return shipping unless otherwise agreed.

5. Intellectual Property

All content on the Site (including text, images, logos, and designs) is owned or licensed by Stunning Hardwoods LLC. Unauthorized reproduction, distribution, or commercial use is prohibited.

6. Acceptable Use

You agree not to use the Site or Services for any unlawful or fraudulent purpose, to interfere with Site operation, or to attempt unauthorized access to our systems or customer data.

7. Limitation of Liability

To the fullest extent permitted by Texas law, Stunning Hardwoods LLC is not liable for any indirect, incidental, or consequential damages arising out of your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

8. Warranties Disclaimer

Except as expressly stated in writing, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

NOTICE TO TEXAS CONSUMERS: To the extent allowed by law, you waive your rights under the Texas Deceptive Trade Practices-Consumer Protection Act, Texas Business & Commerce Code §17.41 et seq., a law that gives consumers special rights and protections. You should seek the advice of an attorney about your rights and the waiver of those rights. By agreeing to these Terms, you voluntarily waive those rights to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold Stunning Hardwoods LLC harmless from claims, damages, or expenses (including attorney’s fees) arising from your misuse of the Site or violation of these Terms.

10. Privacy and Data Protection

We collect and process personal information in compliance with the Texas Data Privacy and Security Act (TDPSA) and our Privacy Policy. By using the Site, you consent to our collection and processing of data as described therein.

11. Governing Law and Venue

These Terms are governed by Texas law. You agree that any disputes will be resolved exclusively in the state or federal courts of Travis County, Texas.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Site after posting changes constitutes your acceptance of the revised Terms.
